Terms of Service
Effective September 1, 2026
These Terms of Service ("Terms") govern access to and use of ATHLETIX (the "Service"), operated by Athletix, New York ("Athletix," "we," "us," or "our"). ATHLETIX is a decision-intelligence platform for sports agencies, athletes, and families, combining athlete relationship management with AI-assisted research and recommendations for NIL, transfer, school-program, contract, and related career decisions. By creating an account, accessing, or using the Service, you agree to these Terms.
1. Who May Use ATHLETIX
- ATHLETIX is invite-only. Agencies obtain access via an invite code; agency staff members ("Agents") are added by an agency Owner/Admin; athletes and their guardians may be granted limited "Athlete Viewer" access to specific decisions shared with them by an agency.
- The Service is not intended for children under 13. If you are between 13 and 17, you may use the Service only with the involvement of a parent, guardian, or your representing agency, which is responsible for any athlete data it submits about you.
- Agencies are responsible for ensuring they have the right to submit an athlete's information, including obtaining any consent required from the athlete and, where the athlete is a minor, their parent or guardian.
2. The Service and Its Limits
- ATHLETIX provides tools to track athletes, decisions, and offers, and to generate AI-assisted research and recommendations ("Analysis") using large-language-model technology (currently Anthropic's Claude models) combined with web search and, where applicable, public data sources (e.g., the U.S. Department of Education College Scorecard).
- Analysis is a decision-support tool, not professional advice. It is generated by an AI system based on the information provided and information found through automated research, and may be incomplete, outdated, or wrong. Analysis does not constitute legal, tax, financial, medical, or sports-agent advice, and does not replace the judgment of a licensed professional or the agency's own diligence.
- Any content describing state NIL law, eligibility rules, or a coach's track record is informational research only, not legal advice or a professional evaluation, and must be independently verified before being relied upon for a real decision.
- We do not guarantee any particular outcome (NIL value, playing time, scholarship, admission, etc.) from using the Service.
3. Accounts and Security
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- You must notify us promptly of any unauthorized use of your account.
- We use a third-party identity provider (Hexclave) to manage authentication; your sign-in is subject to that provider's own security practices as well as ours.
4. Athlete Data You Submit
- Agencies (and, where applicable, athletes/guardians using Athlete Viewer access) are solely responsible for the accuracy of information they submit about an athlete, including personal, athletic, academic, financial, and social-media information.
- You represent that you have the right to submit any athlete information you provide, and, where required, the athlete's or their guardian's consent to do so — including before connecting any athlete's social media account (see Section 6).
- Do not submit information you are not authorized to share, or that is knowingly false.
5. Documents You Upload
- Uploaded documents are scanned for malware before processing. We may reject or remove a document that fails a security scan.
- You must have the right to upload any document you submit, and must not upload documents containing another party's confidential or legally protected information without authorization.
6. Connecting Social Media Accounts
- Connecting an athlete's social media account (YouTube, TikTok, X) is optional, uses read-only access, and requires you to affirmatively confirm you have the athlete's or their guardian's permission before connecting. We log this confirmation.
- We never receive or store the athlete's social media password; authentication happens directly with the platform.
7. Billing
- Paid plans are billed through Stripe. By subscribing, you authorize recurring charges to your payment method until you cancel.
- Analysis usage beyond your plan's included allotment may be billed via purchased analysis credits, which do not expire but are non-refundable once consumed.
- Fees are non-refundable except as required by law or as separately agreed to in writing.
8. Acceptable Use
- Do not use the Service to violate any law, any sports governing body's rules (NCAA, conference, state athletic association, etc.), or any third party's rights.
- Do not attempt to circumvent security controls, scrape the Service, or use it to build a competing product.
- Do not misuse the AI features to generate content for a purpose other than genuine athlete decision support.
9. Intellectual Property
We retain all rights in the Service, its underlying technology, and our own content. You retain rights in the athlete data and documents you submit ("Your Content"), and grant us a license to use Your Content solely to provide and improve the Service to you.
10. Termination
- We may suspend or terminate access for a violation of these Terms, non-payment, or a real risk to the security or integrity of the Service.
- You may stop using the Service at any time; certain provisions (e.g., payment obligations already incurred, limitations of liability) survive termination.
11. Disclaimers and Limitation of Liability
THE SERVICE, INCLUDING ALL ANALYSIS, IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT ANALYSIS IS ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATHLETIX WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANY DECISION MADE IN RELIANCE ON ANALYSIS PROVIDED BY THE SERVICE.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after a change constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
